Yes but you are speaking about subjective conditions which are a lot harder to substantiate. Here this is a case of completely missing features and functionality. Access can sell the TI based on the sound and provided features, not by misleading the buyer by stating features that do not exist i.e.

This is blatant false advertising in any book and is indeed very pursuable. Whether or not one (or a group) would do so is another matter.
When I attempted to return my unit the vendor (whom I won't name) was going to impose a 20% restocking fee until I mentioned that the unit was not sold as advertised. It would seem that this vendor is grown frustrated with the number of returns and B-stock that he has on the TI. And rightfully so! On the day I was to ship it back I read of the 1.1 update and thought, Hey it's a great sounding synth a couple more weeks won't hurt for the update. So I kept it. It's been 2 months and everyday I say "A couple more weeks won't hurt for the update" :roll:
I did not purchase this as a Virus D to be used in standalone mode (my C does that). I bought it for all the features spec'd on access' website. So I am waiting as patiently as possible and enjoying these discussions while I do (I'm having a musical equivalent of writers block anyways! :lol:
